  1. Purpose of Assignment: The purpose of this assignment is to conduct an analysis of case law and its applicability to a set of facts.
Course Competency: Perform legal research in order to apply law to facts and create tailored documents for legal professionals in various areas of law.
    Instructions:Content:

    • CIVIL TRACK: Opposing counsel in Angela Frame’s case has provided us with two cases that they believe will be crucial. Angela owns a health food store as well as a church next door. They have advertising that links the two together. The church is bankrupt, but the health food store is a successful, flourishing business. The church has been sued for wrongful death for one of the members, who passed away during a “healing ritual.” The opposing counsel has asked the court to allow the health food store to be considered a partner of the church and be included in the suit so they can recover a higher judgment. The emailed argument is located here:

  2. You will need to review the case law provided from opposing counsel and format a memo discussing your thoughts on the likely outcome of this argument. You should discuss the cases presented, as well as research and analyze any additional cases you think would be helpful in formulating an outcome. (For the purposes of this motion you can ignore the jurisdiction of any cases. This is a rare issue and we will potentially argue case law from other states to the court.)

      • If you are in the Civil Section, you will be continuing your work on the case of Mark Bouden. We are in the middle of the discovery phase in Mark’s case, and opposing counsel has sent over some discovery requests for information from Mark. Mark has “roughed out” some responses but is unhappy with having to respond to every question. Your job will be to insert his responses to the discovery requests. A word document containing the requests can be found here:

      -Capstone-Interrogatories-Client-Responses-CIVIL.pdf
A file of his responses has been provided for you here:

Please format the responses, as well as any objections. You may need to research appropriate objections to the interrogatories he does not want to answer. A template with general objections and formatting has provided as well for you to review:

      • If you are in the Criminal Section, you will be continuing your work on the case of Tony Smulders. We are in the middle of the discovery phase in Tony’s case, and the prosecutor is being slow in providing information pertaining to the breathalyzer exam and the breathalyzer itself. Specifically, we requested the make and model of the breathalyzer, as well as the records of any maintenance on the machine itself. We also requested the certified results of the breathalyzer exam. We have requested the information from the state previously and received a one page summary of the blood alcohol level of our client, but the certified results were not presented. We also have no response to the rest of our requests as of yet, and it has been over 3 months. I would like you to prepare a motion to compel for my review. A template has been provided for you here.
